Tax question: I am disabled and receive both a disability pension and social security disability. My husband wants to develop a network marketing distributorship to which he is starting to become successful. We want to own the distributorship 50-50 for security purposes but don't want to affect my social security or disability payments. Can we do this? If not, what do you recommend?

Answer from a tax professional: The courts have held that earnings from being a distributor in a network marketing company is earned income. This could, and probably will eliminate your social security disability payments and might affect your disability payments too. You should consider setting up a limited partnership where the disabled spouse is a 50% limited partner. Any earnings as a limited partner is NOT considered earned income and isn't subject to social security, which is one big savings. In addition, earnings as a limited partner shouldn't affect either your social security or disability pension because these earnings aren't considered earned income. BIG NOTE OF WARNING: to be a true limited partner, you have to be doing nothing! You can't work the business or help out to any substantial extent. You should be passively receiving your earnings without any effort on your part. If you actively work the business as a limited partner, the IRS and courts may hold you to be a general partner and treat you like a co-distributor.
